SB 531 makes ADUs by-right in single-family zoning, including R-1 through R-3 contexts, caps permit fees at $500, and eliminates the family-only occupancy requirement. Loudoun homeowners with larger lots may see one of the strongest practical benefits because detached new-construction ADUs become a more realistic planning category.
The law does not erase building code, dimensional standards, septic or well questions, or health and safety review. It does, however, change the baseline. Instead of treating a detached ADU as an unusual request, homeowners can begin from the premise that a compliant unit should be allowed after July 1, 2027.
